Whither the “Improvement Standard”? Coverage for Severe Brain Injury after Jimmo v. Sebelius.Joseph J. Fins, Megan S. Wright, Claudia Kraft, Alix Rogers, Marina B. Romani, Samantha Godwin & Michael R. Ulrich - 2016 - Journal of Law, Medicine and Ethics 44 (1):182-193.
As improvements in neuroscience have enabled a better understanding of disorders of consciousness as well as methods to treat them, a hurdle that has become all too prevalent is the denial of coverage for treatment and rehabilitation services. In 2011, a settlement emerged from a Vermont District Court case, Jimmo v. Sebelius, which was brought to stop the use of an “improvement standard” that required tangible progress over an identifiable period of time for Medicare coverage of services. While the use (...)

What, When and How? Spanish Native and Nonnative Uses of Politeness: ¿Qué, cuándo y cómo? El uso de la cortesía por hablantes nativos y no nativos de español.Marina Terkourafi & María J. Barros García - 2014 - Pragmática Sociocultural 2 (2):262-292.
The current study reports on three role-plays investigating the understanding and uses of politeness by native speakers of Spanish from Spain, native speakers of English from the United States, and nonnative speakers of Spanish from the United States. Motivated by the different characterization of Peninsular Spanish and U.S. American cultures as solidarity and distancing cultures, respectively, we expected that American English speakers would be more inclined towards the use of politeness strategies linked to the protection of face, while Spaniards would (...)

  5. Introduction.P. J. E. Kail & Marina Frasca-Spada - 2005 - In Marina Frasca-Spada & P. J. E. Kail, Impressions of Hume. New York: Oxford University Press.
The original occasion for most of the chapters contained in this book was the result of a wish to establish a forum where Hume scholars of various provenances and convictions could meet and discuss all matters Humean, profiting from the very differences that commonly would make it difficult for them to cross paths with each other. This wish materialised in an interdisciplinary workshop, ‘Hume Studies in Britain’, held in Cambridge in September 2000. The title of the book is intended to (...)

    “Frequently Asked Questions” About Genetic Engineering in Farm Animals: A Frame Analysis.Katherine E. Koralesky, Heidi J. S. Tworek, Marina A. G. von Keyserlingk & Daniel M. Weary - 2024 - Food Ethics 9 (1):1-20.
Calls for public engagement on emerging agricultural technologies, including genetic engineering of farm animals, have resulted in the development of information that people can interact and engage with online, including “Frequently Asked Questions” (FAQs) developed by organizations seeking to inform or influence the debate. We conducted a frame analysis of FAQs webpages about genetic engineering of farm animals developed by different organizations to describe how questions and answers are presented. We categorized FAQs as having a regulatory frame (emphasizing or challenging (...)

Centennials, FOMO, and Loneliness: An Investigation of the Impact of Social Networking and Messaging/VoIP Apps Usage During the Initial Stage of the Coronavirus Pandemic.Elena Fumagalli, Marina Belen Dolmatzian & L. J. Shrum - 2021 - Frontiers in Psychology 12.
The current COVID-19 pandemic has had obvious, well-documented devastating effects on people's physical health. In this research, we investigate its potential effects on people's mental health. Many people have experienced social isolation, as countries attempt to stem the spread of the disease through confinement and other forms of social distancing. Intuitively, such social isolation may increase feelings of loneliness, and people may take logical steps to reduce their feelings of social isolation and loneliness. One route is through the use of (...)

    Impressions of Hume.Marina Frasca-Spada & P. J. E. Kail (eds.) - 2005 - New York: Oxford University Press.
Impressions of Hume collects brand-new essays from leading scholars in different philosophical, historiographical, and literary traditions within which Hume is a canonical figure. To some his writings are vehicles for intuitions, problems, and arguments which are at the center of contemporary philosophical reflection; others locate Hume's views against the background of concerns and debates of his own time. Hume's texts may be read as highly sophisticated literary-cum-philosophical creations, or as moments in the construction of the ideology of modernity; these are (...)

Mental Health Care and Policy (In)justice in Ontario: Making Intersections Visible.Abraham J. Cohen, Marina Morrow & Edward Rawson - 2024 - Studies in Social Justice 18 (3):461-480.
This paper applies an Intersectionality Based Policy Analysis Framework to Ontario’s current mental health plan – The Roadmap: A Plan to Build Ontario’s Mental Health and Addictions Services – in order to identify the contextual influences, underlying values and assumptions, which promote or undermine the uptake of human rights and equity as a mental health policy priority in Ontario. We found that dominant framings of the “problem” of mental health (as lack of access, coordination or integration, as a fiscal drain, (...)

Does time heal all wounds? How is children’s exposure to intimate partner violence related to their current internalizing symptoms?Román Ronzón-Tirado, Natalia Redondo, María D. Zamarrón & Marina J. Muñoz Rivas - 2022 - Frontiers in Psychology 13.
The effects of time and the longitudinal course of the children’s internalizing symptoms following Intimate Partner Violence Exposure are still of great interest today. This study aimed to analyze the effect of the frequency of IPVE, adverse experiences after the cessation of the IPVE and the time elapsed since the termination of the violent relation on the prevalence of anxiety and depression among children. Participants were 107 children and their mothers who had been victims of IPV and had existing judicial (...)

In this essay, we suggest practical ways to shift the framing of crisis standards of care toward disability justice. We elaborate on the vision statement provided in the 2010 Institute of Medicine (National Academy of Medicine) “Summary of Guidance for Establishing Crisis Standards of Care for Use in Disaster Situations,” which emphasizes fairness; equitable processes; community and provider engagement, education, and communication; and the rule of law. We argue that interpreting these elements through disability justice entails a commitment to both (...)

Analysis of evil in Schelling’s Freiheitsschrift through Heidegger’s account of dissemblance and Αλήθεια.Marina Marren - 2021 - International Journal of Philosophy and Theology 82 (2):97-115.
In this paper, I offer an analysis of evil in Friedrich W. J. Schelling’s Philosophische Untersuchungen über das Wesen der menschlichen Freiheit (1809). Schelling develops an account of the sui-genesis of God out of the two principles. These principles are 1) the dark ground (dunkler Grund) that belongs to God and 2) the self-revelation of God, who actualizes the dark ground, which grounds God antecedently. These two principles also contain in themselves the possibility and the intelligibility of the human world. (...)

  13. Thinking About Different Nonexistents of the Same Kind: Reid's Account of the Imagination and its Nonexistent Objects.Marina Folescu - 2015 - Philosophy and Phenomenological Research 93 (3):627-649.
How is it that, as fiction readers, we are nonplussed by J. K. Rowling's prescription to imagine Ronan, Bane, and Magorian, three different centaurs of the Forbidden Forrest at Hogwarts? It is usually held in the philosophical literature on fictional discourse that singular imaginings of fictional objects are impossible, given the blatant nonexistence of such objects. In this paper, I have a dual purpose: on the one hand, to show that, without being committed to Meinongeanism, we can explain the phenomenon (...)

C’è del pragmatismo in J.L. Austin? Una rilettura delle proposte austiniane sul tema della verità.Marina Sbisà - 2015 - Esercizi Filosofici 10 (2).
On the one hand, Austin appreciates truth as the aim not only of science, but also of philosophy. On the other hand, truth in his works is demythized, contextualized, or even relativized. I analyze this ambivalence by considering some aspects of Austin’s thought which may appear close to pragmatism: his claims that the bearer of truth is assertion as a speech act, that speech acts are to be assessed as felicitous and infelicitous before being assessed as true or false, and (...)

Van Helmont’s hybrid ontology and its influence on the chemical interpretation of spirit and ferment.Marina Paola Banchetti-Robino - 2015 - Foundations of Chemistry 18 (2):103-112.
This essay proposes to discuss the manner in which Jan Baptista van Helmont helped to transform the Neoplatonic notions of vital spirit and of ferment by giving these notions an unambiguously chemical interpretation, thereby influencing the eventual naturalization of these ideas in the work of late seventeenth century chymists. This chemical interpretation of vital spirit and ferment forms part of Helmont’s hybrid ontology, which fuses a corpuscular conception of minima naturalia with a non-corporeal conception of semina rerum. For Helmont, chemical (...)

Is commenting an expositive illocutionary act?Marina Sbisà - 2024 - Pragmatics and Cognition 31 (2):294-317.
The paper outlines an analysis of the act of commenting within the author’s Austin-inspired speech-act theoretical framework. The general lines of that framework are concisely expounded, and it is suggested that the act of commenting should be described as belonging to Austin’s Expositives. The preliminary problem whether the act of commenting is illocutionary at all (given the absence of a performative use of the verb “to comment”) is discussed, and it is argued that nothing stands in the way of analyzing (...)

  18. Selfhood and Relationality.Jacqueline Mariña - 2017 - In Joel Rasmussen, Judith Wolfe & Johannes Zachhuber, The Oxford Handbook of Nineteenth-Century Christian Thought. Oxford University Press. pp. 127-142.
Nineteenth century Christian thought about self and relationality was stamped by the reception of Kant’s groundbreaking revision to the Cartesian cogito. For René Descartes (1596-1650), the self is a thinking thing (res cogitans), a simple substance retaining its unity and identity over time. For Immanuel Kant (1724-1804), on the other hand, consciousness is not a substance but an ongoing activity having a double constitution, or two moments: first, the original activity of consciousness, what Kant would call original apperception, and second, (...)

Autonomy, Moral Constraints, and Markets in Kidneys.S. J. Kerstein - 2009 - Journal of Medicine and Philosophy 34 (6):573-585.
This article concerns the morality of establishing regulated kidney markets in an effort to reduce the chronic shortage of kidneys for transplant. The article tries to rebut the view, recently defended by James Taylor, that if we hold autonomy to be intrinsically valuable, then we should be in favor of such markets. The article then argues that, under current conditions, the buying and selling of organs in regulated markets would sometimes violate two Kantian principles that are seen as moral constraints. (...)

Background Empirical studies of surrogate decision-making tend to assume that surrogates should make only a 'substituted judgement'—that is, judge what the patient would want if they were mentally competent. Objectives To explore what people want in a surrogate decision-maker whom they themselves select and to test the assumption that people want their chosen surrogate to make only a substituted judgement. Methods 30 undergraduate students were recruited. They were presented with a hypothetical scenario about their expected loss of mental capacity in (...)

The Political Philosophy of Fénelon by Ryan Patrick Hanley.S. J. John J. Conley - 2022 - Journal of the History of Philosophy 60 (4):699-700.
In his monograph, Ryan Patrick Hanley offers a revisionist interpretation of the political philosophy of François de Salignac de la Mothe-Fénelon, archbishop of Cambrai. A series of Enlightenment commentators and their progeny have hailed Fénelon as a political subversive who boldly attacked the injustices of the reign of Louis XIV and who prepared the arrival of an egalitarian society with socialist and pacifist traits. Hanley, however, argues that Fénelon actually defended a more moderate and realistic model of political society than (...)
